By purchasing from this website and/or registering on the website, you are agreeing to be bound by our terms and conditions. We may choose to update the terms and conditions from time to time, by updating this posting.
 
(1)               Age (you, not the wine!)

You must be 18 years or over to purchase alcoholic beverages from this site.   It is an offence to purchase or attempt to purchase alcohol if you are under the age of 18
.  

If you are buying wine as a gift, the recipient must also be over 18 years of age. Our couriers may ask for proof of age of the recipient on delivery. If this proof can not be given, unfortunately, the wine can not be delivered.

Once you have taken receipt of delivery, the recipient is responsible for it.
 
(2)               Delivery

Our minimum order quantity is just one bottle. 

After you have placed your order, we will send you an order confirmation email with the subject “Thank you for your purchase from wine2laydown.com”.

For orders received by 1pm, we will endeavour to deliver the next working day. We will only accept orders for goods that we have in stock, or that our distributors have in stock in the UK. If we have to call in stock from our distributors, there may be a three day delay in despatch. For deliveries in central and northern Scotland, Scottish islands, Northern Ireland and the Scilly Isles, please allow up to five days for delivery.

Our delivery charge is per delivery address, regardless of whether the order is for one bottle or a thousand bottles. Normally, our delivery cost is £5.99 for England, Wales, Northern Ireland and Central and Southern Scotland, so it is worth ordering a decent quantity. However, if you are lucky enough to live far away from southern England, the delivery cost increases. *Certain postcodes in Scotland (including the Highlands and Scottish Islands) and the Scilly Isles attract a higher delivery cost of £14.99, regardless of the quantity being delivered. The post codes affected are: AB31, AB33-38, AB44-45, AB51-55, FK18-21, G84, IV1-63, KA27-28, KW1-17, PA20-78, PH19-52, TR21-25, HS1-9, ZE1-3. Delivery can be made to other parts of the UK and outside the UK, but please email us at info@wine2laydown.com or call us on 0845 873 9300 (this is classed as a local call) for details of these delivery costs.

We normally deliver Monday to Friday, 9.00am to 5.30pm, but during busy times, deliveries may be made outside of these times. We can deliver to places of work if you request it. 

If you are not in when the courier attempts to deliver, then a card will be left informing you that an attempted delivery had been made. If you do not contact the courier company, a second attempt will be made. Alternatively, you may authorise the courier to leave the order in a certain place. There is a textbox in the shopping checkout where delivery instructions can be left should no one be home to meet the courier. Let us know if you want the courier to leave your order in a certain spot (e.g. at back door or in shed etc). IMPORTANT NOTE: if a request is made for wine to be left unattended we cannot be held responsible if the wine goes missing after the courier has delivered it. If there is no contact after the second missed delivery, the wine will be returned to us and we will credit your account, less a £10 non-delivery charge.

In the unlikely event that there are any breakages, the carrier will need to collect the damaged case including the damaged contents. If you have any queries regarding delivery please contact us at info@wine2laydown.com
 
(3)               Prices and payment

All prices are quoted in pounds sterling, and may be per item or bottle or per case, as marked. The prices include duty and VAT at a rate of 17.5%, unless otherwise clearly stated. Any delivery charges and/or gift wrapping and premium packaging are additional to the unit price quoted.  Each bottle is 75cl unless otherwise stated.

We accept payment by Maestro/Solo, Switch, Visa and MasterCard. In the case of payment by bank transfer or cheque, the order(s) will only be shipped when cleared funds have been received into our bank account.

Any discounts offered are based on previously advertised, non-discounted prices that were available for consumers to buy for at least 28 consecutive days in the previous 6 months via the website. Where a particular wine is part of a pre-mix case with a general discount applied, the discounted price for the case is relative to the previously advertised, non-discounted prices for the constituent wines. We reserve the right to terminate any special offer at any time, without notice

(4)               Vouchers and promotional codes

If you have a voucher to redeem against the purchase of wine from us, the terms and conditions on that voucher apply, and you agree to be bound by those terms and conditions. Vouchers can be withdrawn or not honoured without notice. Vouchers can not be transferred, sold or auctioned.

(5)               Group Orders

If you want to have orders delivered to more than one delivery address, then you can simply upload the address list at the time of placing the order.

Where an order(s) contain(s) goods to be delivered to more than one delivery address, it is the responsibility of the customer placing the order(s) to ensure that all delivery address(es) provided to wine2laydown.com are correct. If goods are delivered to an incorrect address(es) as a result of incorrect information provided by the customer, wine2laydown.com will not take responsibility for this and the customer will be charged for the cost of replacement goods and the cost of delivering the replacement goods to the correct address(es).  If the goods are returned to us, then we will refund the cost of the purchase (excluding delivery cost) less a £10 collection fee.

(6)               Wine does run out, sometimes

If we run out of a particular vintage, we may choose to substitute this with another vintage or with wine of equal or greater value. We will email you before we despatch the goods to let you know. We may choose to refund your money instead of sending out a substitute. Please note that this is a very unusual occurrence. If you have any concerns, please email us at info@wine2laydown.com.

(7)               Virtual Cellar

An alternative to storing wine yourself, is to let us store it for you. This has a number of benefits to you: the wine will not be drunk by mistake, the wine will be stored in proper conditions and if you decide to sell the wine (rather than drink it), we can provide auction houses with proof of storage conditions, maximising your return.

When you buy wine, you have an option to ship to cellar at the checkout. You will be charged the first year’s storage charges of £10 per case of 12 bottles (so it is always better to buy and store in boxes of 12). The wine will be shipped from our warehouse to a third party’s warehouse where it will be stored in a ‘proper’ wine warehouse. We will mark the wine as your property and will send you a certificate of ownership for the wine. On the first anniversary of storage, we will charge a further storage charge equivalent to 83p per case per complete month remaining in the year. This means that you will have paid storage up until the end of December in the year following the purchase. We will then charge storage at the end of December for each year thereafter. Please note that storage charges may change in the future.

You can view your stocks of wine in your account/virtual cellar on our website at any time. You can add to your virtual cellar at anytime. You can also send us an email to info@wine2laydown.com if you want to take the wine out of storage. You can either collect the wine yourself, or you can ask us to deliver it to you. We will charge you at cost for the delivery. Alternatively, we can arrange to sell the wine on your behalf. We will sell the wine and retain 15% of the gross sales value plus any outstanding storage and delivery charges, forwarding the balance of the revenue generated, to you.

Please note that you can only take the wine out of storage if the storage charges are fully paid up to date. 

If storage charges become more than three months overdue, we will sell the wine on your behalf, deducting our standard 15% gross sales value in addition to the outstanding storage and delivery charges, and forward the balance to you.

(8)               Return, Refund and Cancellation Policy

Hey, we all make mistakes. If you order something by mistake, let us know before we ship it out and we will cancel the order and refund you any money.  If you change your mind within seven days of placing the order, return the unopened product and we will refund the value of the product, less any shipping costs.

Unfortunately, all the wine we sell is sold in glass bottles. Unfortunately, glass is fragile and breakages sometimes occur. Just for your information, we use a specialist wine courier company that has proven to have hardly any breakages, but we understand that sometimes they happen. If they do occur, all that we ask is that you let us know within three days of the courier delivering the wine to you. We will then ask you to return (via the courier at our cost) the original package and any other spoilt bottles. We will then credit you for the wine returned or redeliver a replacement (hopefully without any breakages on the second time!).

(9)               Liability and really small print

We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications or courier service provider in connection with the performance of this Agreement.

The images, words and descriptions within the website are for guidance only. Final products may look different to the image shown.

Wine2laydown.com may change or add to these terms and conditions for security, legal or regulatory reasons. We will not use this right to vary the terms of any special offer that applies to you.

The sale of the goods takes place only when the wine is despatched from our warehouse. Until the time, wine2laydown.com will not be bound to supply the goods or agree the price.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen's Advice Bureau.
 
You agree and acknowledge that we own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site, and to the business of Forstep Limited, trading as wine2laydown.com, including the structure, design and layout of the web site, the styles of the wines and the virtual cellar.
 
You are entitled to use our web site in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our web site or any part of it in any other manner.
 
All persons, individual and corporate, are prohibited from providing hypertext or other links to the wine2laydown.com web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.

Nothing in these Terms and Conditions shall exclude wine2laydown.com liability for personal injury or death caused by its negligence.
We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
- loss or damage was not foreseeable to both parties when the contract was formed;
- loss or damage was not caused by any breach on the part of the supplier;
- loss or damage relates to business and/or non-consumers.
 
We will not be liable for loss or damage caused by the customer handling the wine. In particular we will not be liable for spillages or breakages.
 
Customers should also be aware of the following inherent risks and warnings:
- Alcohol should be consumed in moderation
- A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
- Port and red wine in particular may cause staining if spilt so extra care should be taken.
- Sparkling wines and champagnes can be volatile due to the build up of gasses, extra care should be taken when opening these.
 
By providing your details to wine2laydown.com on our web site, you consent to wine2laydown.com maintaining, recording, holding and using the information you give wine2laydown.com at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.
 
We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your wine to you, e.g. our delivery company. From time to time, wine2laydown.com may send information about discounts and offers on wine, port, champagne, chocolate or accessories, unless you have told us not to do so by emailing us info@wine2laydown.com.
 
Relevant United Kingdom law will apply to these terms and conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction. Forstep Limited, trading as wine2laydown, is registered in England and Wales, registration number: 06161004.  The registered address is Chestnuts, Green End, Braughing, Hertfordshire, SG11 2PE.
